ADDITIONALLY, CHRYS KYNG CHRYS KYNG LLC IS NOT LIABLE FOR DAMAGES IN CONNECTION WITH (I) ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, DENIAL OF SERVICE, ATTACK, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS OR LINE OR SYSTEM FAILURE; (II) LOSS OF REVENUE, ANTICIPATED PROFITS, BUSINESS, SAVINGS, GOODWILL OR DATA; AND (III) THIRD PARTY THEFT OF, DESTRUCTION OF, UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF YOUR INFORMATION OR PROPERTY, REGARDLESS OF OUR NEGLIGENCE, GROSS NEGLIGENCE, FAILURE OF AN ESSENTIAL PURPOSE AND WHETHER SUCH LIABILITY ARISES IN NEGLIGENCE, CONTRACT, TORT, OR ANY OTHER THEORY OF LEGAL LIABILITY. THE FOREGOING APPLIES EVEN IF THE CHRYS KYNG CHRYS KYNG LLC HAS BEEN ADVISED OF THE POSSIBILITY OF OR COULD HAVE FORESEEN THE DAMAGES. IN THOSE STATES THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR THE DAMAGES, OUR LIABILITY IS LIMITED TO THE FULLEST POSSIBLE EXTENT PERMITTED BY LAW. IN NO EVENT SHALL CHRYS KYNG, CHRYS KYNG LLC, http://www.ChrysKyng.com (including but not limited to all affiliated brands of Chrys Kyng) CUMULATIVE LIABILITY TO YOU EXCEED $100.


EVENTS AND ADVERTISING

I grant permission to Chrys Kyng, Chrys Kyng LLC & their brands & team the irrevocable and unrestricted right to reproduce the photographs and/or video images taken of me, or members of my family at Chrys Kyng, Chrys Kyng LLC Events for the purpose of publication, promotion, illustration, advertising, or trade, in any manner or in any medium. I hereby release Chrys Kyng, Chrys Kyng LLC, their team and its legal representatives for all claims and liability relating to said images or video. Furthermore, I grant permission to use my statements that were given during an interview or guest lecture, with or without my name, for the purpose of advertising and publicity without restriction and I waive my right to any compensation.


ENTIRE AGREEMENT; WAIVER; HEADINGS

This Agreement constitutes the entire agreement between you and Chrys Kyng, Chrys Kyng LLC, http://www.ChrysKyng.com (including but not limited to all affiliated brands of Chrys Kyng) pertaining to the Site and Service and supersedes all prior and contemporaneous agreements, representations, and understandings between us. No waiver of any of the provisions of this Agreement by the Company shall be deemed, or shall constitute, a waiver of any other provision, whether or not similar, nor shall any waiver constitute a continuing waiver. No waiver shall be binding unless executed in writing by the Company. The subject headings of this Agreement are included for convenience only and shall not affect the construction or interpretation of any of its provisions.

3. Waiver and Release: You hereby waive, release, and discharge Chrys Kyng LLC, http://www.ChrysKyng.com (including but not limited to all affiliated brands of Chrys Kyng), its officers, directors, employees, practitioners, agents, and representatives from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury that may be sustained by you or to any property belonging to you, whether caused by the negligence of Chrys Kyng LLC, http://www.ChrysKyng.com (including but not limited to all affiliated brands of Chrys Kyng) or otherwise, while participating in any in-person or virtual sessions/events.

4. Indemnification: You agree to indemnify and hold harmless Chrys Kyng LLC, http://www.ChrysKyng.com (including but not limited to all affiliated brands of Chrys Kyng), its officers, directors, employees, practitioners, agents, and representatives, from any loss, liability, damage, or cost that may occur due to your participation in these sessions/events.

5. Health and Fitness: You certify that you are physically and mentally fit to participate in the sessions/events and have not been advised otherwise by a qualified medical professional.

6. Binding Effect: This release is binding on you, your heirs, assigns, and personal representatives.
